1. Acceptance of Terms

By subscribing to or using BibsAlert ("Service"), operated by BibsAlert ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these Terms, do not subscribe to the Service.

2. Description of Service

BibsAlert is an informational notification service. We monitor the websites of major marathon events and send email alerts to subscribers when ballot (lottery) windows open or registration deadlines approach.

Important Disclaimer: We are an independent service. We are NOT affiliated with, endorsed by, or connected to the Abbott World Marathon Majors, the TCS London Marathon, the BAA, or any other race organization. Our Service does NOT guarantee you entry into any race. We provide alerts only.

3. Accounts and Authentication

Our Service operates on a "passwordless" basis.

• You agree to provide a valid, accessible email address during checkout.
• Access to your subscription settings is granted via a secure link sent to that email address.
• You are responsible for maintaining the security of your email account.

4. Subscription and Billing

• Fees: Access to the Service requires a yearly subscription fee (currently $5.00 USD/year).
• Auto-Renewal: Subscriptions automatically renew annually unless cancelled.
• Cancellation: You may cancel your subscription at any time via the "Manage Subscription" link on our website. Cancellation is effective immediately for future billing cycles, though you will retain access for the remainder of your paid year.
• Refunds: Due to the low-cost, digital nature of the product, we generally do not offer refunds for partial years, unless required by local law.

5. Intellectual Property

The content, design, and code of BibsAlert are owned by us. The names, logos, and dates of specific races (e.g., "London Marathon") are the trademarks of their respective owners. We use them strictly for informational/identifying purposes to inform you of their events.

6. Limitations of the Service

While we strive for 100% accuracy, we rely on public information provided by race organizers. Therefore:

• We are not responsible if a race organizer changes a date without public notice.
• We are not responsible if a race website crashes or is unavailable.
• We are not liable if email alerts land in your spam folder (though we follow best practices to avoid this).

7. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. We disclaim all warranties, express or implied, including warranties of accuracy, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

To the maximum extent permitted by law, our liability shall be limited to the amount you paid for the Service in the past 12 months (i.e., $5.00). We shall not be liable for any missed race entries, travel costs, or indirect damages.

9. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email. Continued use of the Service after changes constitutes acceptance.
